Intellectual property reports
This page is for rights owners reporting an intellectual-property problem on Jinu that is not a copyright infringement: trademark, counterfeit and replica goods, registered design rights, patents, unauthorized use of a logo, and right of publicity. It explains who may file, what a report has to contain, what we do when one arrives, and how a member whose listing was removed can respond. **Copyright complaints follow a separate, statutory procedure at Copyright and intellectual property.**
Which complaints belong here
Jinu handles intellectual-property complaints through two doors, and sending a complaint through the wrong one is the most common reason a valid report is delayed. The difference is not administrative: the copyright procedure's contents are fixed by United States copyright law, and this one is not.
Report these here
- A trademark used without authorization, in a listing title, description, photograph or seller name.
- Counterfeit, replica or knock-off goods, or goods otherwise offered without the rights owner's authorization.
- A registered design right or design patent.
- A patent.
- Unauthorized use of your logo, including as an avatar or inside a listing image.
- A false claim of authorized-dealer, reseller or partner status.
- Right of publicity: the use of a person's name, image, likeness or voice to sell something without their permission.
Report these at /dmca instead
- A photograph, video, listing text or other creative work of yours copied into a listing or a profile.
- Any copyrighted work of yours reproduced anywhere on Jinu.
- Any complaint whose answer to "what did they do" is "they copied my work".
If the problem is that someone copied your work, use Copyright and intellectual property instead. If the problem is not an intellectual-property one at all, and is a scam, a prohibited item, harassment or an inaccurate listing, use Reporting and moderation, which is faster than either of these pages.
Who may file a report
A report may be filed by the owner of the right or by a person authorized to act on the owner's behalf, such as in-house counsel, outside counsel, or a brand-protection agent instructed by the owner.
If you are acting for someone else, say so and describe your authority in the report itself. We are not able to act on a complaint about a right we cannot connect to the person complaining, and a report that leaves the relationship unstated will come back to you with that question rather than with a removal. A member of the public who has noticed a suspected counterfeit but does not hold the right should use the report control on the listing, described in Reporting and moderation, rather than this page.
Before you file, please consider whether the use is authorized or lawful. The lawful resale of a genuine item, accurate descriptive use of a trademark to say what an item is, comparative reference, and use that is licensed or exhausted under the first-sale doctrine are all common reasons that a use is not an infringement.
What a report must contain
Send your report by email to legal@jinu.app, with "Intellectual property report" in the subject line. Include all of the following. A report that omits an element may be ineffective and may be returned to you for completion.
- (a) Your full name, and your organization.
- (b) Your relationship to the rights owner: that you are the owner, or a description of the authority under which you act for the owner.
- (c) The type of right you are asserting: trademark, trade dress, counterfeit goods, registered design, patent, right of publicity, or another right you should name.
- (d) The mark or work itself: the word mark, logo, design or other subject matter, described precisely enough that we can compare it against the listing.
- (e) The registration number and the jurisdiction in which the right is registered, where it is registered. If the right is unregistered, say so and explain the basis on which you hold it, for example use in commerce.
- (f) The full Jinu URL of every listing complained of, for example https://www.jinu.app/listing/<id>. A seller's name or a search result is not a location we can act on. One report may cover many URLs.
- (g) An explanation of what specifically is infringing in each listing, for example that the article offered is a counterfeit, that the mark appears in the title or in the photographs without authorization, or that authorized-dealer status is falsely claimed.
- (h) A statement that you have a good-faith belief that the use complained of is not authorized by the rights owner, its agent, or the law.
- (i) A statement that the information in your report is accurate.
- (j) Your typed full legal name at the end of the report, as your signature, and contact details at which we can reach you: a mailing address, a telephone number and an email address.
Counterfeit goods are prohibited whether or not you complain
Counterfeit and replica goods are independently prohibited by our Prohibited and restricted items policy. A listing offering them may be removed on that basis whether or not a rights holder complains, and members who post them face the enforcement described in Reporting and moderation.
That is worth knowing for two reasons. A rights owner does not have to police every listing for us to act on the obvious ones. And a member whose listing was removed under the prohibited-items policy has not necessarily been the subject of a complaint by anyone, so the response to that removal is an appeal under Appealing a decision rather than a dispute with a rights owner.
What we do when we receive a report
We aim to acknowledge every complete report within three business days, to act on it promptly, and to complete a removal within ten business days of receiving a complete report. These are our operating targets, not contractual commitments, and we do not guarantee an outcome.
When we act on a report, we may remove or disable access to the material identified in it, notify the member who posted it, and provide that member with a copy of the report, including the complainant's identity and contact information. Assume that the contents of your report will be forwarded to the member who posted the material, and that we may publish or share reports in transparency reporting with personal information redacted. This is the same commitment the copyright procedure makes, and it exists because a member cannot meaningfully respond to an accusation they are not allowed to see.
We may also, at our discretion and consistent with the Terms of Service, retain a copy of the removed material, limit features on the account, or suspend or terminate it. Removal of a listing under this procedure does not entitle the member to a refund of any publishing fee.
Jinu operates one repeat-infringer policy, not two. Valid reports under this page count towards it exactly as copyright notices do. That single policy is stated in the Repeat infringers section of Copyright and intellectual property, and it governs here; this page deliberately does not restate it, because two statements of one policy in two documents is how the two come to say different things.
If your listing was removed
If your listing was removed under this procedure and you believe the decision was wrong, you may respond. Say why: that the article is genuine and lawfully resold, that you are authorized by the rights owner, that the mark is used descriptively to say what the item is, or that the report has identified the wrong listing. Include the full Jinu URL of the listing and any evidence you have, such as a receipt, an invoice from an authorized distributor, or a licence.
Send that response through Appealing a decision, which is where these appeals are read and which sets out what to include, how long you have and what to expect. A person reviews every appeal, and we aim to respond within ten business days.
This is not the copyright counter-notice procedure. A counter-notice under 17 U.S.C. 512(g) is a statutory instrument with defined contents and consequences, including consenting to the jurisdiction of a court, and it applies only to material removed under the copyright procedure at Copyright and intellectual property. Nothing on this page requires you to submit one, and nothing here prevents you and the rights owner from resolving the dispute directly between yourselves.
Reports made in bad faith
A report under this page is a formal accusation against a named member, and it is acted on. Do not file one to remove a competitor's listing, to enforce a right you do not hold, or to press a dispute that is really about price, service or a soured transaction.
A person who knowingly misrepresents that material infringes their rights may be liable to the member whose listing was removed, and to Jinu, under the law that applies to the claim being made. We do not cite the copyright statute's misrepresentation provision here, because it governs copyright notices and this page is for everything else; the exposure a false trademark or publicity complaint creates arises under other law instead, and it is real.
Independently of any legal exposure, we may decline to act on further reports from a complainant who has filed reports in bad faith, and we may tell the affected member that we have done so.
